In the present case, the wife is fighting a legal battle to get the compensation amount since 2014.

After divorce, if the wife wants expenses or compensation from the husband, then the correct details of her income will also have to be given. The Punjab-Haryana High Court in a case dismissed the petition for not giving the correct details of the husband’s property to recover the amount after fixing the compensation of Rs 60 lakh on behalf of the family court. Justice Alka Sarin said in the judgment that in the present case, the wife is fighting a legal battle to get the compensation amount since 2014.

The High Court sympathizes with the petitioner, but to get the amount, the exact property of the husband has to be given so that the amount can be recovered by attaching the property. The petition was filed on behalf of the wife saying that she was married on 16 January 2011. After marriage, differences started between the two, due to which both decided to live separately. The family court of Panchkula allowed the petition filed for divorce on 20 May 2014. Along with this, the wife was instructed to give 60 lakh rupees to the husband as living expenses or compensation. For non-payment of the amount, a petition was filed on behalf of the wife in the court of Panchkula. When the court asked for information about the husband’s property, the wife gave information about the husband’s property located in Balachaur.

The Panchkula court, while giving information about this property to the court of Balachaur, asked it to take action to block it. When the Balachaur court gave a notice regarding the property, a person objected to it and said that this property belonged to him. On this, the court of Balachaur sent the case file back to the court of Panchkula. The Panchkula court, while dismissing the petition, asked to give correct information about the property. The court of Panchkula filed a petition in the High Court against the decision, asking that the husband should be paid the fixed amount as living expenses and set aside the decision of Panchkula and Balachaur courts.

The information given by the wife was not found correct

During the hearing, the High Court found that the husband is currently residing in the United Kingdom (UK). The wife got information that she has property in Balachaur but this information is not correct. In such a situation, now the wife will have to give information about the husband’s property to get the amount, which can be attached and recover the amount.
