Reliance saved from paying insurance claim: complainant’s son was driving without license; accident claim not received

The Chandigarh District Consumer Commission has rejected the claim of the owner of the vehicle in a road accident as investigation revealed that his son was driving the vehicle at the time of the accident and did not have a driving licence. At the same time, in the Daily Diary Register (DDR) lodged with the police, the complainant side had told that a person named Gurpreet Singh was driving the vehicle at the time of the accident. On the other hand, Gurpreet Singh had said in the statements given before the surveyor of Reliance that Taranpreet Singh was driving the vehicle at the time of the accident.

Taranpreet had also confessed to driving himself in the statements. Taranpreet did not even have a driving license during the accident. Calling it against the terms and conditions of the insurance, Reliance General Insurance Company Limited rejected the claim demand.

Kartar Singh of Fatehabad (Haryana) had made Reliance and Nissan Motor Pvt Ltd, Industrial Area, Phase 1 Chandigarh a party. The complainant said that he had bought a Nissan company vehicle and Reliance General Insurance had got it insured from July 19, 2017 to July 18, 2018. On January 17, 2018, Gurpreet Singh was driving this vehicle from Ambala towards Patiala. In front of Laxmi Farm on Nabha Road, the car rammed into a truck in heavy fog. The car was damaged by this. On the same day, DDR was done to Police Post Sanctuary in Patiala.

The complainant said – illegally canceled the claim

The vehicle was sent to Reliance to collect the claim but the claim was canceled on March 17, 2018. The insurance company said that at the time of the accident, not Gurpreet Singh but Taranpreet Singh was driving the vehicle, which did not have a valid licence. This fact came to the fore in the investigation as well. The complainant claimed that the claim was canceled on the basis of illegal investigation. Gurpreet Singh was driving the vehicle during the accident. He also had a valid driving license. Accordingly, a consumer complaint was lodged.

Investigation revealed – Taranpreet was driving

Reliance said in its reply that the insurance of the vehicle valued at Rs 4,43,797 was lost during the relevant time period. However, during investigation it came to light that Taranpreet Singh was driving the car and not Gurpreet Singh. He did not have a driving license during the incident. Reliance got the incident investigated by Shubham Arora (investigator). On February 17, 2018, he reported that the complainant’s son Taranpreet Singh was driving the vehicle at the time of the incident. Gurpreet Singh and Taranpreet had clearly revealed from their statements that Taranpreet Singh was driving the car.

The Investigator had recorded the statements of the complainants, Gurpreet Singh and Taranpreet Singh. The claim was rejected as per the terms and conditions. On the other hand, Nissan Motor had no role in the matter. Hence his name was dropped from the party. At the same time, seeing the lack of merit in the complainant’s case, his demand was rejected.
