Congress leader Rahul Gandhi’s membership of Parliament was canceled at around 2.30 pm on Friday. He was a member of the Lok Sabha from Wayanad, Kerala. The Lok Sabha Secretariat has given information about this by issuing a letter. Rahul’s name has also been removed from the website of the Lok Sabha. In 2019, Rahul had given a statement regarding the Modi surname in the assembly of Karnataka. He had said – Why is the surname of all thieves Modi?

In this defamation case, the court of Surat had sentenced Rahul Gandhi to 2 years imprisonment at 12.30 pm on Thursday. However, he got bail after 27 minutes.

The Supreme Court, in its judgment on July 11, 2013, had said that any MP or MLA would be disqualified for membership of Parliament or Legislative Assembly from the date of conviction in the lower court.

The court had given this order in the case of Lily Thomas vs. Union of India. Earlier, there was a provision not to terminate the membership of MLA or MP till the final decision of the court. Here, about 3 hours after the verdict, Rahul tweeted, ‘I am fighting for India’s voice, I am ready to pay any cost’.

  1. According to legal experts, the Lok Sabha Secretariat has declared Wayanad, the parliamentary seat of Rahul Gandhi, vacant. The Election Commission can now announce the election on this seat. Rahul Gandhi can also be asked to vacate the government bungalow in Delhi.
  2. If the higher courts also uphold the sentence of Rahul Gandhi, then he will not be able to contest elections for the next 8 years. After completing 2 years of sentence, he will be disqualified for six years.
  3. Rahul Gandhi can now challenge the decision of the Surat court in the higher court. The Congress has also questioned the legality of the action that only the President can disqualify an MP in consultation with the Election Commission.

Rahul Gandhi’s lawyer Babu Mangukiya told that the court of Chief Judicial Magistrate HH Verma had convicted Rahul Gandhi under sections 499 and 500 of the IPC. It also granted him bail and suspended the sentence for 30 days to enable him to appeal to the High Court.
