There will be no need for a magistrate’s order or warrant for this. Earlier BSF could take action only within 15 km. Mamta is angry with this change. He says that common people are getting upset due to this. BSF has more power, which does not allow coordination between people and officers.

Mamta had accused BSF of killing the villagers
Mamta had said in May 2022 that BSF men are killing people by entering villages and throwing them in Bangladesh on the other side. He had said that BSF, which comes under the Central Government, smuggles cows across the International Border and kills people and throws their dead bodies in Bangladesh, but the Bengal Police is blamed for it. That’s why I have asked the state police to stop BSF. In December, the West Bengal assembly also passed a resolution against expanding the jurisdiction of the BSF.

Center had increased the jurisdiction of BSF in October 2021
In October last year, by amending the BSF Act, the Union Home Ministry extended the jurisdiction of the Border Security Force (BSF) along the international border of Pakistan and Bangladesh. After this, BSF officers were allowed to search, arrest and seize up to 50 kilometers from the country’s border in West Bengal, Punjab and Assam.

Punjab and West Bengal opposed the decision
This decision had created a political controversy in Punjab. Earlier in any action in Punjab, BSF used to work with the help of local police. After the new amendment, the Congress and the Akali Dal strongly opposed it. The then Chief Minister of Punjab Charanjit Singh Channi called it an attack on the rights of the state. Like Punjab, Bengal also opposed this decision.

The impact of the central government’s decision on 12 states of the country
Based on the provisions under Section 139 (1) of the BSF Act 1968, the decision of the Union Home Ministry affected 12 states of the country. These include Gujarat, Punjab, Rajasthan, West Bengal, Assam, Manipur, Mizoram, Tripura, Nagaland and Meghalaya, Union Territories of Jammu and Kashmir and Ladakh.

Assam, Bengal and Punjab are more affected by the new law
Out of these 12 states, the jurisdiction of BSF in the states of Assam, West Bengal and Punjab has increased much more than before. In these states, earlier BSF could take action up to 15 kilometers inside the border. Now she will be able to take action up to 50 kilometers without any order or warrant from the magistrate.
