The Election Commission has filed an affidavit in the Supreme Court demanding that leaders accused in criminal cases be barred from contesting elections after chargesheets are filed and the charges are framed.

The commission said it wanted to completely decriminalize politics. He is in favor of it. But it is not in his jurisdiction to stop the leaders of criminal image from contesting elections. To do this, a law has to be made.

A bench of Supreme Court Justice KM Joseph and Justice BV Nagaratna has asked the Central Government to file a reply within 4 weeks on the Election Commission’s affidavit in the said matter.

Demand in the petition – The leaders on whom the charges are framed should not be allowed to contest elections
Advocate Ashwani Upadhyay has filed a petition in the Supreme Court demanding that politicians who are chargesheeted in a criminal case and charges are framed in the court should be barred from contesting elections.

Not only this, the Election Commission should be empowered to prevent such people from contesting elections and take action against political parties who violate the rule in this context.

Earlier, while hearing this petition, the Supreme Court issued a notice to the Election Commission and sought its reply.

Out of these 51, 37 are former MPs and 5 have died. NIA has pending investigation against 4 MPs and MLAs. Out of these 2 are MPs. ED has pending investigation against 51 MPs.
