A petition seeking to provide free sanitary pads was filed in the Supreme Court on 2 November.
The Supreme Court on Monday sent notices to all state governments on whether girls studying in classes 6th to 12th would get free sanitary pads. Dr. Jaya Thakur has demanded to issue instructions to the governments to provide free sanitary pads. The petition has been filed by his lawyers Varinder Kumar Sharma and Varun Thakur.
A bench of CJI DY Chandrachud and Justice PS Narasimha has also sought response from the central government regarding the scheme. The next hearing of the case will be in January.
The matter is related to the cleanliness of girls
The court also sought the help of Solicitor General Tushar Mehta in this matter. He said that the petitioner is a social activist and has raised the important issue of cleanliness of girl students in all government and government-aided schools in the country. so told
Petition also demanded separate toilet in schools
The petition states that the right to health in India derives from the Directive Principles of State Policy. It is a right under Article 21 of the Constitution of India which guarantees the right to life and dignity. Poor adolescent girls of 11 to 18 years are not aware about menstruation and hygiene. Many girls drop out of school due to its lack.
The petition also sought that a direction be issued to have separate toilets and sweepers in all government, aided and boarding schools. Along with this, the method of disposal of menstrual waste should also be taught.
This is the current situation in India
Many schemes are being run in the country to provide period products to women for free or at low rates. But due to lack of awareness and administrative negligence, most of the schemes die midway. The Bihar government had launched a scheme to provide free sanitary pads to schoolgirls. But in many schools of Bihar, boys were also being given the benefit of this scheme in a fake way.
Apart from this, sanitary napkins are being made available at the rate of Re 1 per pad under ‘Pradhan Mantri Bhartiya Jan Aushadhi Pariyojana’ (PMBJP). The Rajasthan government has released a budget of Rs 200 crore for this.
Scotland is the first country to provide free sanitary pads, Rajasthan is the first state
All menstrual products are being given free of cost to women in Scotland. In 2020, the Scottish Parliament enacted the law. Scotland has become the first country in the world to provide this facility to women. On the other hand, if we talk about India, then in Rajasthan, giving free pads to all women under the Udaan scheme has started from May this year.
